2019 Paid Family Leave - What You Need to Know

New York’s Paid Family Leave Act went into effect in 2018. Since then, AmTrust has analyzed our claims to data to learn more about how paid family leave is being used.



While agents and employees have begun to familiarize themselves with the new law, a few things are changing for 2019. Here’s the highlights of new information around rates and benefits:
  1. 2019 NY Paid Family Leave contribution and premium rate is 0.153% of an employee’s gross wages per pay period not up to and not to exceed an annual maximum employee contribution of $107.97.
  2. If an employee’s contributions reach the annual maximum of $107.97 before the end of the calendar year, the employee shall not be liable for any additional contributions for that year.
  3. Eligible employees may receive up to 10 weeks of leave taken in either continuous or intermittent increments.
  4. The NY Paid Family Leave benefit payments equal 55% of the employee’s average weekly wage, not to exceed the statewide average weekly wage of $1,357.11. Thus making the maximum benefit payment of $746.41.
